- What does PERM stand for?
It stands for Program Electronic Review Management regulation which implemented on March 28, 2005 to replace the previous labor certification application either under traditional or Reduction in Recruitment process.
- Can I still file through the traditional process?
You cannot, the PERM application will be the only way to file Labor Certification after March 28, 2005.
- Is the PERM recruiting process more complicated than before?
There are more required recruiting processes to be completed before the labor certification can be filed. However, the basic requirements remain the same.
- Can I file the PERM if I filed labor certification before?
A provision in the PERM rules allows the employers to refile pending labor certification under the new system and the Priority Date of the old case can be retained.
- Can I save time by refiling the PERM?
The PERM process usually takes about 90 to 180 days to be adjudicated. It is far faster than the original application.
- What kind of position can file PERM?
Basically all the positions that need labor certification can file through PERM.
- Is my salary high enough for the PERM?
It will depend on the prevailing wage determination made by the state agency where your position is located and also depends on your employer’s financial capability in matching the wage.
- If my employer does not have internet access, can I still file PERM?
Yes, you can file the form by mail but all the recruiting requirements should be completed.
